Here’s a summary of the latest Brexit developments (as per August 2022).

The date when CE marking ceases to give market access to the GB market is December 31, 2022. Consequently, from 1 January 2023, the UKCA marking must be used on most products placed on the GB market (see below for concerned legislations/regulations). This also includes goods that have been assessed by an EU recognized notified body.

If your product was placed on the GB market with the CE mark before the end of 2022, in most cases it does not need to be remarked to UKCA requirements and can continue to circulate on the GB market until it reaches the end of its use. For existing imported stock of products that have been manufactured, CE-marked and imported under contract into the GB market before the end of 2022, there is no need to re-test or re-mark.

One piece of good news from the UK Government is that they will introduce new and updated legislation allowing manufacturers place the UKCA mark on a label affixed to the product or on a document accompanying the product. This exemption is proposed to end on December 31, 2025.

The UK government will also be introducing legislation to reduce re-certification/re-testing costs for the UKCA marking. I would assume that this legislation will focus on products that where assessed and certified by an European Notified Body prior to end of 2022.
